With this privacy statement, we inform you how we use, share and otherwise process the personal data we collect from you. We treat all personal data in accordance with the provisions of European and Austrian data protection law.

2. Personal data

We collect, process and use your personal data only in accordance with Article 6 (1) GDPR or, where applicable, Article 9 GDPR. In principle, we only process your personal data if:

  • you have given your express consent to this in accordance with Article 6 (1) (a) GDPR, or
  • this is necessary for the execution of contractual relationships with you (Article 6 (1) (b) GDPR), or
  • processing is necessary to fulfill one of our legal obligations (Article 6 (1) (c) GDPR).

The specific legal basis applicable to the respective processing purpose can be found below in the explanations of the individual processing purposes. Within the meaning of the GDPR, personal data is all data about natural persons whose identity is determined or at least identifiable and which contains individual information about personal or factual circumstances, e.g. name, address, e-mail address, telephone number, date of birth, age, gender, social security number, proof of income, video recordings, photos.

3. Rights of data subjects

As our contractual partner or as a data subject in general, you have the right to information about your stored personal data as well as a right to correction, data transfer, objection, restriction of processing and blocking/anonymization or deletion of the data, provided that there is no exception (e.g. legal storage obligation) and in accordance with legal provisions.

If there are any changes to your personal data, we request that you notify us accordingly. You have the right to withdraw your consent to the use of your personal data at any time. Your submission for information, deletion, correction, restriction, objection and/or data transfer can be sent to the email address provided above.

If you are of the opinion that the processing of your personal data by us violates applicable data protection law or that your data protection claims have been violated in any other way, you have the option to complain to the competent supervisory authority. In Austria, the data protection authority is responsible for this www.dsb.gv.at.

4. Data security

Your personal data is protected through appropriate organizational and technical measures. These precautions relate in particular to protection against unauthorised, unlawful or even accidental access, processing, loss, use and manipulation. Notwithstanding efforts to maintain a consistently high level of due diligence requirements, it cannot be ruled out that information that you provide to us via the Internet may be viewed and used by others. Please note that we therefore assume no liability of any kind for the disclosure of information due to errors not caused by us during data transmission and/or unauthorized access by third parties (e.g. hacking of email accounts, interception of faxes, etc.).

5. Transfer of data to third parties

In order to fulfill our contractual or legal obligations, the purpose of data processing, or insofar as there is a legitimate interest of parties involved (third parties), it may also be necessary to transfer your data to third parties. Possible recipients may include: private and public bodies that disclose or require information in connection with the contractual relationship (e.g. subcontractors), insurance companies (e.g. in connection with claims), tax consultants, business consultants or lawyers, authorities, IT, software and telecommunications service providers, tax authorities and magistrate. This transfer of your data is carried out exclusively on the basis of the GDPR.

If the data is transferred to third parties for individual processing purposes who require further information, this can be found under the respective purpose.

As a rule, your data is processed within the EEA. However, we only transfer your personal data outside the EEA to countries for which the EU Commission has decided that they have an adequate level of data protection or we take measures to ensure that all recipients have an adequate level of data protection, for which we conclude standard contractual clauses (2010/87/EC and/or 2004/915/EC).

6. Data storage

In accordance with the applicable data protection requirements, we are required in accordance with Article 5 (1) (e) GDPR to delete personal data immediately as soon as the purpose for processing has been completed. In this context, we would like to point out that legal storage obligations and periods represent a legitimate purpose for processing personal data.

In any case, we will store and store data in personal form until the end of the business relationship or beyond that insofar as relevant for tax law, for BAO's tax retention periods of 7 years. Insofar as there are deviations for individual processing purposes, this will be carried out for the respective purpose.

1. Server log files

In order to optimize our websites in terms of system performance, usability and provision of useful information about our services, the operator of the respective website automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. This includes your Internet protocol address (IP address), browser and language settings, operating system, referrer URL, your Internet service provider, error logs and date/time.

We reserve the right to check this data retrospectively if we become aware of concrete evidence of illegal use. These log files are processed for 6 months.

The legal basis is, on the one hand, the fulfilment of the contract, specifically the provision of our website free of charge (Article 6 (1) (b) GDPR), in our overriding interest in the security and functionality of our website (Article 6 (1) (f) GDPR) and

  1. What are cookies? Cookies are small text files that are stored on the device used (mobile/desktop) for a certain period of time when you visit a website. Cookies cannot run programs or cause damage to the device you are using. Cookies are also automatically removed after a certain period of time.

    At Vereinsplaner, we store cookies that only contain a unique number and have no meaning outside of our website/application. We use this number exclusively to identify you the next time you visit our website/application for functions that require registration and login. This means that the use of cookies increases the usability and security of our website. You have the right and the option to reject our cookies by changing your browser settings. However, our application cannot be fully used in this case.

  2. What types of cookies are there? To better understand why cookies are so important, we will give a brief overview of the types of cookies there are:

    • Strictly necessary cookies help with basic navigation on a website and the display of certain functions. Without this type of cookie, the core functionality and security of a website is not available. No consent is required for this type of cookie.

    • Functional and analytical cookies are primarily used for learning and analysis purposes in order to improve comfort and website experience. Where appropriate, also through the additional use of cookies from third parties, such as Google Analytics.

    • Advertising and social media cookies help you to use information collected on the website for the best possible user convenience and also for additional marketing purposes. As a result, this type of cookie is also known as a “targeting cookie.” The second type of cookies that fall into this category are suitable for performance purposes, as they make them more pleasant to use in general and improve marketing messages. Finally, there are ways to share content with a community, such as blog posts or to interact between a website and a social media channel. These cookies are known as “interaction cookies.”

  3. Which cookies are used by Vereinsplaner? We categorize our cookies into the following four areas. We store cookies for a maximum period of 36 months.

    • Attitude: Some Vereinsplaner features require cookies for user-specific settings, such as when logging in. Examples: PHPSESSID, COOKIEINFORMATION,

    • Safety: We use cookies to maintain a high level of security on our website. For example, these cookies prevent unauthorised persons from accessing them. Example: auth

    • Statistics: We use cookies to make Vereinsplaner even more user-friendly and to learn from our users' website behavior. This includes Google Analytics and Hotjar, for example. Examples: _ga, _gac, _gcl_au, gid, _hjid

    • Marketing: In order to be able to use our advertisements in a targeted manner and to be able to provide you with optimal advertising that really interests you in terms of Vereinsplaner, we use cookies here. Example: _fbp

  4. How can you disable cookies? You can easily determine for yourself which cookies should be saved via our “Cookie Manager”, linked in the footer. Or you can determine in your browser settings which cookies should be deleted or prevented on your computer or mobile device. However, this may restrict the use of Vereinsplaner.

3. Web analytics services | Google Analytics

We use web analysis services such as Google Analytics (web analysis service from Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (https://google.at/intl/de/analytics/). These web analysis services also use cookies. The information generated by the cookie about the use of our website and application (including your IP address) is also transmitted to servers located in other EU countries, such as in the USA, and stored there. The web analysis services will use this information to compile evaluations and reports on website activity for website operators and to provide other services related to website activity and Internet usage. This information may be transferred to third parties if required by law or if third parties process this data on behalf of web analysis services. Web analytics services with servers in the USA comply with the privacy policy of the “US Safe Harbor” Agreement and are registered with the US Department of Commerce's “Safe Harbor” program. By using our website/application, the user agrees to the processing of data collected about him by web analysis services such as Google Analytics in the manner and for the purposes set out above.

We use Google Analytics with the “anonymizeIp ()” extension so that the IP addresses are only further processed in abbreviated form to rule out direct personal identification.

4. Support Suite & Help Center | Zendesk

We use Zendesk, a customer service platform from Zendesk Inc., 989 Market Street #300, San Francisco, CA 94102, to process customer inquiries. For this purpose, necessary data such as last name, first name, postal address, telephone number, e-mail address is collected via our website. Zendesk is a certified participant in the “Privacy Shield Framework” and therefore meets the minimum requirements for legally compliant order data processing.

If you contact us by email or via the form on the website, we will only use the personal data you provide to process your specific request. The data provided will be kept confidential. The data provided and the message history with our service desk are saved for follow-up questions and subsequent contacts. The data entered in the contact form is processed on the basis of your consent (Art. 6 para. 1 lit. a DSGVO).

5. Live Chat | Zendesk

Zendesk's live chat tool (see Support Suite & Help Center for information about the company) is a plugin that allows website visitors to contact us anonymously as a Vereinsplaner team and ask their questions. This helps us to understand visitors in order to provide website visitors with even greater convenience and to respond to the questions in a targeted manner (https://www.zendesk.com/).

Zendesk's live chat tool (see Support Suite & Help Center for information about the company) is a plugin that allows website visitors to contact us anonymously as a Vereinsplaner team and ask their questions. This helps us to understand visitors in order to provide website visitors with even greater convenience and to respond to the questions in a targeted manner (https://www.zendesk.com/).

6. Payment provider | Stripe

You can use our services to trigger booking processes. Insofar as this is necessary to fulfill the contract, data is also transferred to our payment service provider or the bank responsible for payment processing. The scope of the data is limited to the minimum necessary for the purpose of contract processing.

When paying by credit card, instant bank transfer or direct debit, payment is processed via Stripe from the payment service provider Stripe Payments Europe Ltd, Block 4, Harcourt Centre, Harcourt Road, Dublin 2, Ireland. 7. Facebook | Meta

The social network facebook.com is operated by Meta Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA and is used for user interaction. The Facebook button links to our Facebook profile. Facebook's website has their privacy policy.

The purpose of data collection and processing of data and use of the data by Facebook, as well as the types of data (scope of data) can be found in the privacy policy published by Facebook itself; see: http://www.facebook.com/policy.php. In order to achieve the best possible transparency, we summarize the key points for the user:

The data collected in this way is used to analyze usage behavior and to provide, select, evaluate and understand the advertisements that Facebook provides on and off Facebook (this also includes advertisements provided by Facebook subsidiaries or on their behalf) as well as to generate statistics about users. Facebook also uses the data available to it to improve its advertising and measurement systems so that Facebook can display relevant advertisements to users on and outside of Facebook services and measure the effectiveness and reach of advertisements and services. 8. Instagram | Meta

Instagram is part of the Meta Group. The person responsible for data protection is therefore Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2 Ireland. The Instagram social media button links to our Instagram profile. Instagram's website has its privacy policy (see also the Facebook section).

The purpose of the data collection and processing of the data as well as the use of the data by Instagram or Facebook, as well as the types of data (scope of data), can be found in the privacy policy published by Instagram itself; see: https://help.instagram.com/519522125107875. The information provided above about Facebook is also used for Instagram.

If the person concerned follows the social media link to Instagram (i.e. if he clicks on the Instagram social media button), data will be processed in accordance with privacy policy processed, collected, transmitted, stored, disclosed and used by Instagram. 9. YouTube | Alphabets

Youtube is part of the Alphabet Group based in Mountain View in Silicon Valley, California. Youtube is a video platform where companies/people can upload videos so that other people can consume these videos over the Internet. We use the YouTube platform to be able to provide instructional videos on the Vereinsplaner features to our clubs. The YouTube social media button and the YouTube videos, which are integrated into our website and tool via iFrame, link to our Vereinsplaner YouTube channel. On the YouTube website, their privacy policy applies (https://policies.google.com/privacy?hl=de) or those of the Alphabet Group.

If the person concerned follows the link to YouTube (i.e. by clicking on the YouTube social media button or an integrated YouTube video), data is processed, collected, transmitted, stored, disclosed and used in accordance with YouTube's privacy policy. Furthermore, when you visit the YouTube website, cookies (https://www.youtube.com/static?gl=DE&template=terms&hl=de) are stored on the person concerned's device. If the person concerned is the owner of a YouTube account, the information transmitted by Youtube or Google/Alphabets can be linked to this account.

10. AI telephone hotline | Fluently

We use Fluently, a tool from Softwarebude OG, Hafenstraße 47/51, 4020 Linz | Kaplanhofstraße 45, 4020 Linz, to process 24/7 telephone inquiries. The infrastructure is hosted on Railway in the Netherlands and the LLM runs on ChatGPT 4o on Azure in Sweden.
